The purpose of using the hard stand to store boats at Port Franklin is to provide a secure and convenient solution for boat owners, ensuring their vessels are well-protected when not in use. This facility allows jetty owners to safely store their boats out of the water, preventing unnecessary wear and tear and reducing maintenance costs. Additionally, the hard stand promotes better organization and utilization of our marina space, enhancing the overall boating experience for our community. By offering an initial three months free of charge, followed by an affordable monthly fee, we aim to support and encourage responsible boat ownership within our vibrant coastal community.

Port Franklin Hard Stand Boat Storage Terms, Rules, and Conditions

1. Definitions

  • Boat: The vessel identified on the registration form.
  • Customer: The person and/or entity identified on the jetty owner’s registrar.
  • Hard Stand: The designated area at Port Franklin Foreshore for the short term storing of boats.
  • Committee: The Port Franklin Committee of Management responsible for the administration and oversight of the Hard Stand.

2. Terms and Conditions of Use

2.1 The Customer shall:

  • Keep the area surrounding the boat clean and tidy at all times.
  • Deposit all garbage in the provided receptacles.
  • Ensure all cradles, trailers, mooring lines and fittings are of suitable strength and design to adequately secure the boat.
  • Provide adequate fenced off barrier around the vessel to protect the boat and surrounding public.

2.2 The Customer shall not:

  • Make or permit any noise or disturbance that may be an annoyance to others.
  • Carry out any spray painting or hazardous activities without prior written consent from the Committee.
  • Permit any activity that contravenes local regulations, including environmental and safety laws.

3. Storage Fees

  • The initial three months of boat storage are free of charge for existing jetty owners.
  • From the fourth month onward, a fee of $50 per month will be charged.
  • All fees must be paid punctually as required by the Committee.

4. General Rules

4.1 Storage Eligibility:

  • Storage is available to existing jetty owners only.
  • The Customer must have their boat registered with the Committee.

4.2 Maintenance and Safety:

  • All boats must be secured in a manner that ensures their stability and safety.
  • No hazardous materials are to be stored in or around the boat.
  • The Customer must ensure their boat is insured for public liability.

4.3 Conduct and Use:

  • No person shall make or permit any noise on a vessel or elsewhere on the Hard Stand which is likely to cause annoyance to any person.
  • No person shall deposit or discharge into the waters of the Hard Stand any substance of any kind, whether liquid or solid.
  • The Customer shall not leave on any pier or Hard Stand area anything that restricts the passage of pedestrians.

4.4 Responsibility and Liability:

  • The Customer acknowledges that the boat and any chattels in, on, or fixed to the boat shall remain at the risk of the Customer.
  • The Committee shall not be liable for any damage to or theft or loss from the boat, and any goods, gear, or machinery situated on or around the boat.
  • The Customer agrees to indemnify and hold harmless the Committee from all claims, suits, and demands made by any person in respect of the boat or any chattels stored.

5. Termination of Agreement

  • Any breach of the above conditions shall be deemed a breach of this agreement, entitling the Committee to terminate this contract forthwith without notice.
  • The Committee reserves the right to seize and retain the boat until all outstanding moneys payable by the Customer have been paid in full.
  • The Committee may, after 21 days of unpaid dues, sell the boat and apply the proceeds towards any outstanding amounts and costs.

6. Notices

  • Any notice required to be given to the Customer may be delivered personally, posted by ordinary mail, or sent by email to the address provided on the registration form.

7. Insurance

  • The Customer must take out and at all times keep in force public liability insurance covering their boat while stored at the Hard Stand.

By using the Port Franklin Hard Stand, the Customer agrees to abide by these terms, rules, and conditions. The Committee reserves the right to amend these rules as necessary to ensure the safety, security, and proper management of the Hard Stand facilities.
